What is a Right to Work check?
- To clamp down on illegal working, the government is extending Right to Work checks to businesses using self-employed subcontractors.
- This means you will have a legal responsibility to check if each subcontractor is eligible to work in the UK.
- Many contractors already carry out identity checks, some even using Home Office approved software – but without the key feature of an imposter check, the ID checks are not a valid Right to Work check.
If you do not carry out a valid Right to Work check and someone turns out not to have the right to work, you as the employer or engager would face big fines and possibly even personal liability and criminal charges.

We carry out the checks and indemnify you against Home Office penalties
Because Hudson engages the people not you, we can take on responsibility for the Right to Work checks, allowing you to get on with running your business. Our compliance process involves three stages that ensure you are shielded from the cost risk and reputational damage of engaging illegal workers.
STAGE 1: PASSPORT & STATUS VERIFICATION
We partner with a leading Home Office-approved digital verification services provider, or DVS, to verify passports and Right to Work status instantly and securely based on a document check coupled with verification of the individual presenting the document.
STAGE 2: IMPOSTER CHECKS
We carry out the critical ‘imposter’ check (a live video or in person check) required to move from simple ID verification to a full Right to Work check. This proves that the person presenting the documents is the person engaged to carry out work on a self-employed basis.
RESULT: COMPLETE PEACE OF MIND
We handle all record keeping, GDPR and compliance requirements. You are completely shielded from prosecution or enforcement, and we also assist with your client compliance and supply chain due diligence requirements.
